Then a Tempe policeman shows up:
- Cop: Can I see you for a moment?
- Pastor: Sure
- Can I see your ID?
- Why do you need my ID?
- I need to talk to you about a complaint from the neighborhood
- What’s the complaint about?
- It was about using sound amplification
- Well, that’s a legal activity
- Sound amplification is a legal activity?
- Yeah, I can show you
- Oh, I know you can legally amplify. I’m talking about disturbing somebody’s peace.
- Yeah, that’s been ruled on [in court]
- Don’t give me the law, if I could just get your name
- I’m just asking why you need my name. Are you arresting me or charging me with a crime? The state law of Arizona says that you can’t ask for my ID unless I’m being charged with a crime.

- You are a law enforcement official and I’m showing you the law. The law says that in order for you to say that I’m disturbing the peace, it has to be more than a vague generality of your own opinion. You have to have a calibrated meter that demonstrates that I’m over 65 decibels. Do you have a calibrated meter?

- You do. It’s a city code. (He shows him the printed city code.) That’s what it says.
- Ok, so you want to tell me who you are?
- No. Officer, I respect your position. I am a pastor. I respect law enforcement and since you’re a law enforcement, the law says that you can’t ask me for my ID unless you are charging me with a crime. I respect your position immensely and I believe your position is ordained by God in government, but I also believe that you and I both respect the law. And the Constitution says that I have the right to remain silent and not self incriminate. And our state law says that in order for me to get my ID, I am actually gonna have to be cited with a crime.
- So you’re telling me you don’t wanna identify yourself.
- Well, I am happy to tell you my name. It’s pastor Jeff. I’m with Apologia church.

- It’s pastor Jeff. I’d be happy to show you this. This is the Supreme Court ruling, the Federal Court of Appeals ruling, the City of Tempe’s rules when it comes to noise ordinance.
- I understand. I’ve read all of that, actually, I haven’t read the Supreme Court ruling. I understand the city code. What I’m dealing with is a complaint from the neighborhood.
- And I understand where that’s coming from. The problem is, and I know you’re a law enforcement officer, you took an oath to the Constitution and we have freedom of speech rights. And somebody’s saying, „You’re disturbing my peace,” because they don’t like your message or ‘I can hear it’, isn’t a valid reason to undo the Constitution of the United States that says I have freedom of speech. The US Supreme Court has ruled on this. Somebody can’t say I’m disturbing the peace because they don’t like my message, because I’m amplifying my voice. The law that you and I both are committed to states that I’m in a lawful activity right now. I appreciate your position. I have no disrespect for you, but when it comes to law and law enforcement , when someone calls with just a complaint, I think it’s incumbent upon us to at least educate those people that what’s happening here is a lawful activity. It’s not unlawful.
PASTOR JEFF, while awaiting the supervisor: Well, the police have shown up. Last week they cited one of our friends and confiscated property. So, we’re gonna probably have to engage in some legal instructions to the police officers as to what’s actually lawful
The supervisor shows up and identifies herself as a Sergeant from Tempe Police Department
- Sergeant: Hey, who’s been using the megaphone?
- Pastor Jeff: I have
- And what’s your name?
- Pastor Jeff
- And where are you pastor at?

- And what’s your last name Jeff?
- And do you need that for anything?
- Yes we do, cause we have a complaint. That’s why we’re here. Otherwise we would not be here.
- I respect your position. I was just telling this officer over here, in order for me to identify myself, I have to be cited with a crime according to Arizona state law.
- Well, we’re gonna give you a warning right now, so we’re gonna need that for a street check. So, what”s your last name?
- So, the warning is a violation of the law?
- Well, because of the amplified sound device. We’re gonna give you a warning. You can’t use …
- Officer, you can’t do that unless you have a calibrated meter, according to city code,and you test it.
- Oh, we can.
- You can violate this law? (Pastor Jeff shows it to the Sergeant.)
- Because we have a complaint from a citizen.
- A complaint of a legal activity.
- We have a complaint of disorderly conduct.
- Ma’am, if you read the city code, you’ll see, you can’t
- You’ve been given a warning, you can’t use your amplifier sound device. If you do, you go to jail.
- Ma’am, you’re a supervisor and you’re not even looking at the law.
- No, I know the law.
- We’ll file a suit against you.
- Go ahead. (The Sergeant shows her badge number and name to the camera)
- calibrated meter to actually test the level of sound and you noticed she wouldn’t even look at the city code because they’re not concerned with it. It’s apparent that the city of Tempe, two different depts. , including the police dept., are colluding with the business owners here and with Planned Parenthood to stop our constitutionally protected activity.
You’ll notice I was a little more firm with the police department there, in calling them out on their lawless activity because if Christians don’t actually stand on what the law is, and actually confront lawless behavior of the police officers, they will continue to oppress people. They’ll continue to perpetrate injustice. They’ll continue to violate our rights. And they’ll actually try to halt ministries like this that work to rescue children.
So you’ll notice something. When Steven was here, Steven was criminally cited, they confiscated his property, Steven didn’t actually confront the police officers, from what I understand, with the law itself and the city code. So what did they do? They ran roughshod over Steven, they confiscated his property and now he has a court case. But, as soon as YOU CONFRONT THE POLICE OFFICERS WITH THE LAW ITSELF, they don’t even know. And you notice her unprofessional behavior even when she was being asked to look at the law itself, she wasn’t even willing to do that.
And so, I wanna encourage you guys to keep praying for us cause this could get worse for us. We are not stopping. As a matter of fact, I am going right back on this to continue to talk to the women because that is our constitutional right and beyond that it’s also what God commands us, to preach the Gospel. We’re legally allowed to use amplification. They have to have a calibrated meter. They’re not obeying the law and so, as Christians, we have every right to obey the law which is: freedom of speech, we can use amplification. It’s been ruled on by the Supreme Court, by Federal Courts and the City of Tempe.says we can use this. If they think it’s a disturbance, they actually have to use a calibrated meter and test it for a minimum of five minutes. So, that’s it guys. Pray for us. There’s a good chance I am going to jail, so pray for us.
Abusive Cop: Pastor Shuts Down Officer
Police officers with the city of Tempe have been engaging in lawless and unconstitutional behavior in an attempt to prohibit free speech. Recently, they gave a criminal citation to a man who was exercising his 1st amendment right and they stole his property. Apologia Church and Jeff Durbin had contact with the police officers this morning. Jeff Durbin instructed the police that they had no right to stop his free speech and they were in violation of the Federal, State, and City law in attempting to shut down the protest.
